Notice-and-takedown procedure for alleged copyright infringement.
1. Preface
This DMCA Copyright Policy describes the Company’s procedure for receiving, reviewing, and responding to notices of alleged copyright infringement relating to Content made available through the Platform. Although the Company is incorporated and operates in Thailand, the Platform may be accessed globally and the Company may respond to notices consistent with internationally recognized notice-and-takedown practices, including DMCA-style procedures where appropriate. 2. Definitions and Relationship to Other Documents
Capitalized terms used in this DMCA Copyright Policy have the meanings set out in the Terms of Service, including Company, Platform, Customer, Organization, Instructor, Learner, End User, Content, Personal Data, Controller, Processor, and Subprocessor. This DMCA Copyright Policy supplements the Terms of Service and the Acceptable Use Policy. Where applicable, the Company may also respond to legal process or court orders in Thailand or other jurisdictions.
3. General Approach
The Company respects intellectual property rights and expects Customers and End Users to do the same. The Company may remove or disable access to Content alleged to be infringing where the Company receives a sufficiently detailed notice and reasonably determines that action is appropriate, or where action is required by applicable law or a valid legal process.
4. Submitting a Copyright Notice
4.1 Designated Contact

4.2 Required Information
To enable the Company to evaluate a notice, the notice should include sufficient information to identify the copyrighted work claimed to have been infringed and the allegedly infringing Content, including the location on the Platform where the Content appears. The notice should include the name and contact details of the complaining party or authorized representative, together with a statement that the complaining party has a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
The notice should also include a statement, made under penalty of perjury where applicable, that the information in the notice is accurate and that the complaining party is the copyright owner or is authorized to act on behalf of the copyright owner. Electronic signatures are accepted for copyright notices and counter-notices.
4.3 Processing of Notices
Upon receipt of a notice, the Company may request additional information, may forward the notice to the relevant Customer or End User, and may remove or disable access to the identified Content. The Company may take these actions without prior notice where necessary to comply with law, to prevent harm, or to mitigate risk. The Company may also record and retain notices and related communications for compliance and audit purposes.
5. Counter-Notice Procedure
5.1 Submitting a Counter-Notice
If Content has been removed or disabled due to a copyright notice, the affected End User or Customer may submit a counter-notice where permitted by applicable law. Counter-notices may be submitted by email to heretohelp@openmirai.com.
5.2 Required Information
A counter-notice should identify the removed or disabled Content and the location where it appeared before removal. It should include a statement, made under penalty of perjury where applicable, that the person submitting the counter-notice has a good faith belief that the Content was removed or disabled as a result of mistake or misidentification. The counter-notice should include the submitter’s name, address, and contact information, and a statement consenting to the jurisdiction and procedures required to resolve the dispute, which may depend on the applicable legal framework.
5.3 Restoration
Where permitted, the Company may restore the Content after receiving a valid counter-notice unless the complaining party provides evidence of a legal action seeking to restrain the allegedly infringing activity. Content may generally be restored within 10 to 14 business days after receiving a valid counter-notice, subject to variation depending on jurisdiction and risk.
6. Repeat Infringers and Account Actions
The Company may restrict, suspend, or terminate accounts of Customers or End Users who repeatedly infringe intellectual property rights or who repeatedly submit invalid or abusive notices. The Company considers accounts with three or more valid copyright infringement notices within any 12-month period to be repeat infringers. The Company may also take account actions where required by applicable law or a valid legal process.
7. Misrepresentations and Abuse of Process
Submitting false or misleading notices or counter-notices may result in liability under applicable law and may result in account actions under the Terms of Service. The Company may refuse to process notices that are incomplete, abusive, or otherwise not made in good faith.
8. Thailand and Other Jurisdictions
The Company may respond to notices under applicable Thai law, including through cooperation with lawful requests and orders. The Company may also respond to notices under foreign legal regimes where appropriate, but the Company does not guarantee that any specific legal framework will apply in all cases. Parties should seek independent legal advice regarding their rights and obligations.
9. Updates to this DMCA Copyright Policy
The Company may update this DMCA Copyright Policy from time to time. The Company will publish the updated version within the legal documentation portal and may provide additional notice of material changes by reasonable means. Unless otherwise stated, changes take effect on the effective date specified in the updated DMCA Copyright Policy.
