Beta Program Terms
Additional terms that apply to Beta Services and evaluation programs.
1. Preface
These Beta Program Terms apply to any Beta Services made available by the Company, including any evaluation, preview, pilot, or limited release program. They apply to Customers and End Users who access or use Beta Services. The Platform is currently designated as a Beta Service. Effective Date: February 21, 2026. Last Updated: February 21, 2026.
2. Definitions and Relationship to Other Documents
Capitalized terms used in these Beta Program Terms have the meanings set out in the Terms of Service, including Company, Platform, Customer, Organization, Instructor, Learner, End User, Content, Personal Data, Controller, Processor, and Subprocessor, and including the defined term Beta Services. These Beta Program Terms supplement and are incorporated into the Terms of Service. If there is a conflict, the order of precedence is as described in the Terms of Service.
3. Participation and Eligibility
The Company may invite Customers or End Users to participate in Beta Services or may make Beta Services available to selected users. Eligibility criteria and access methods are at the Company's discretion and may be described in the Platform interface or in separate written communications. The Company may require acceptance of additional terms, confidentiality undertakings, or operational requirements as a condition of participation.
4. Nature of Beta Services
Beta Services are provided for evaluation and testing. Beta Services may be incomplete, may not be suitable for production use, may contain defects, and may change or be discontinued at any time. The Company does not commit to providing Beta Services for any minimum period and does not commit to any specific feature set, performance, or roadmap.
5. Feedback and Confidentiality
The Company may request feedback regarding Beta Services. Feedback is handled as described in the Terms of Service, including the Company’s licence to use feedback. If Beta Services are not publicly available, information about Beta Services, including their existence, features, and performance, may be confidential and must not be disclosed to third parties without the Company’s prior written consent, except where disclosure is required by law. Confidentiality obligations apply for two (2) years from the date of disclosure and may be further specified in written invitations.
6. Data and Privacy in Beta Services
Beta Services may process Customer Content and Personal Data. Customers should avoid using Beta Services to process highly sensitive Personal Data or regulated data unless the Company expressly confirms suitability in writing. Beta Services may collect additional diagnostic and usage data to improve the Platform. Such data will be processed in accordance with the Privacy Policy. The Privacy Policy and any executed DPA continue to apply unless the Company states otherwise in writing.
7. Suspension and Termination of Beta Access
The Company may suspend or terminate access to Beta Services at any time, with or without notice, including to protect security, comply with law, or manage program capacity. The Company may also impose usage limits. Upon termination of Beta access, Customers may export their data through the Platform's export features for a period of 30 days. After this period, data may be deleted in accordance with the Company's standard retention practices and may differ from non-Beta services.
8. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, Beta Services are provided on an "as is" and "as available" basis without warranties of any kind. Service levels, support targets, and uptime commitments for Beta Services are not provided unless expressly agreed in writing. Support for Beta Services is available via email at heretohelp@openmirai.com on a best-effort basis. The limitation of liability in the Terms of Service applies to Beta Services to the maximum extent permitted by applicable law.
9. Updates to these Beta Program Terms
The Company may update these Beta Program Terms from time to time. The Company will publish the updated version within the legal documentation portal and may provide additional notice of material changes by reasonable means. Unless otherwise stated, changes take effect on the effective date specified in the updated Beta Program Terms.
